The Supreme Court is set to hear arguments on same-sex marriage in a couple of weeks, and while there is a lot of anticipation around the issue, some people are worried that the court could decide that same-gender couples are not entitled to the same rights and protections that heterosexual couples are.
The case will be heard in June.
According to the American Civil Liberties Union, the Supreme Court has been “failing to make clear that same sex couples do not deserve equal protection under the law.”
This means that same gender couples have to be treated like any other married couples, the ACLU says.
It also means that the Supreme is not taking the same position as states like Mississippi, Indiana, and Oklahoma that have already banned same-gendered marriages.
The court could end up deciding that same genders can be married legally, or that it is not necessary for same- gender couples to be married in the first place.
The ACLU says the case has the potential to “undermine same- sex marriage by redefining the meaning of marriage and by invalidating laws protecting the rights of married couples to marry.”
It also says that the case could open the door to laws that allow same gender marriages.
We have to make sure we get to the bottom of what the courts are going to do in terms of marriage equality, said Jennifer Granick, director of the ACLU’s Lesbian, Gay, Bisexual, Transgender, and HIV Project.
“The court has the power to make the laws that it wants to make, and we have to have the courage to fight for those laws.”
