If both spouses decide to get their divorce overturned after six months have passed, you are allowed to file for both divorces in one go.
If neither spouse files for divorce, the case is then heard by a judge who will decide if either spouse is the rightful owners of the marital property.
When Will Your Marriage Reopen?
When your marriage ends, both of the spouses can request a new marriage license and, if it is approved, the spouses will be allowed to get together again.
In order to get permission for a new wedding, you and your spouse must provide a valid proof of residence document that shows the date of your marriage.
You and your partner must also provide proof of a valid Canadian driver’s licence, which will allow the marriage to continue.
What Happens After a Marriage Is Reopened?
The court may decide that your divorce will be granted after the six-month period has passed.
If it is granted, your marriage will then be able to continue after the expiration of that six-months period.
The decision on your divorce can be appealed to the Supreme Court of Canada, the Court of Appeal or to the Federal Court of Appeals.
