It’s the definition of marriage that many Australian judges and legal scholars have struggled with for years, because the law doesn’t distinguish between married couples.
“There is no right or wrong to be married, there is no moral difference between married and unmarried people, it’s not up to you to decide whether you’re married or not,” Justice Judith Brown told the ABC.
“I’ve never been able to define marriage.”
In Queensland, for example, it is illegal to ask people who are not married to marry you, as long as you have permission from your parents.
“There’s no such thing as a civil marriage, there’s no legal distinction between two people who want to be a couple,” Ms Branson said.
“Marriage is something that has been around for a very long time.”
You can’t make people decide that they’re married.
“Ms Branson believes there is a problem with the way in which the law is being interpreted, because there is often a lack of clear definitions.
She has tried to raise awareness about the lack of definition in the law and has created an online campaign called MarriageRights.com, which has attracted nearly 1,500 responses from around the world.
Ms Brown told News Breakfast that she is not sure if there will be an end to the confusion and she was not sure what the future would hold.”
It seems like a long time since people have actually seen the law clearly,” she said.
It’s not clear if the Government will consider changing the law, but there is some movement on the Federal Government’s proposed legislation to make same-sex couples the legal union of their choice.
